Did he have to prove that that camera measured the speed of Mr. Rogers was right?
A sargeant pulled me over for taking of with 90 Km/Hr, "Which means, 30 Km over the limit. But I will give you only 15 Km./Hr fine."
I said to him: "If I cant' drive over the limit, or can't take off, with a speed, over the limit, you can't cut(devide) that extra bit, in half.!"
And he said: "I understand you need your licence, so, I will give you only 15 Km/Hr, over the limit."
"No, sir! I want my fine, as you said. 30 over the limit. I heard what you said, and that's the way I want my fine, to be written.!"
But my next question is; "Where is your screen. Where is your evidence, to show me that I was doing that speed.!"
"I can't show that to you now! Come to my office another day, and I will show you than."
I went to his office, Wetherill Park Police Station, and asked for Sargeant Robert Malovic. "He is not in now. Come at 3 P.M. this afternoon." At three, P.M., I got my taxi from the base, and I was given a job. I contacted the office next day, and asked for Sargeant Malovic, but someone on the phone said: "Sargeant Malovic has gone on holidays for three months."
Rubbish. A sargeant(sergeant) does not go on holidays for three months.
I went to Court(Fairfield Court), at which there were some extenctions getting built. So, my case was transferred to Bankstown Court House.
I had seen a Legal Aid Solicitor, and she said: "I read your application to see me, but I am only here for Jail Sentences. But I can help you in my this very ofice. What's your problem."
1- He said, I took off with 30 over, he put down 15 over.
2- Police put the date wrong, on my fine(Instead of 24/04/2006, he put 23/04/2006.
3- Police put the time wrong. Instead of 00:40(belongs to 24/04/06), he wrote on my fine, 11:50 P.M.(which belongs to 23/04/07).
4- He had no screen to show me, to prove that it was true, what he said.
5- I had my dashboard to show me my speed, and further more,
6- I had PGS in my car, and it also showed me my speed, all the time.
7- I had a letter from Infringement Processing Bureau(or SDRO), saying: "We believe that the officer put the date wrong on your fine, but your fine still stands"
But Legel Aid Solicitor asked me to plead guilty, since If I plead not guilty, case would be adjourned, I would be brought back, for another day, which is called "Hearing Day", and the case would be much harder to be dismissed.
I asked her: "If I plead guilty, would his Honour Judge listen to me, or would he fine me guilty, straight away?"
"Yes he would listen to you." she said." and she did not even give me, two choices. "Guilty", or "Guilty with explenations".
I pleaded guilty with explenations, and I was given,
a- No conviction,
b- No Points,
c- No fines.
d- & months probation.
About 10-12 days later, I got a letter from R.T.A., and 6 more demerit points were(was) added to my history.
1 point left.
two weeks later, or something, a police offier pulls me over, after I asked him to drop his hi-beam off(or Hallogen lights, or very strong spot lights), and he said.
"Do you remember me?"
"What was the name again, sir?"
I added.
"My name is Malovic!" he said.
"That's enough Sargeant" said I, and carried on "I re-called everything about you. Your name is Sargeant Robert Malovic, and you work at Wetherill Park Police Station. Is that true, Sargeant?"
"Yes it is! I was the officer who gave you a fine, last time, for speeding, and instead of paying, yu went to Court." he said.
"Sorry but, it's you who started raising this subject now, and I tell you why I went to Court, and What happend in Court!
a- You cut 30 Km/hr over speeding in 1/2),
b- You had no evidence, to show me.
c- You put date and time, wrong.
That's why I went to court, and I won the Court, if you want to know. I didn't have to pay your fine."
"I don't want to know about it! Give me your Licence" he added.
I gave him my licencwe, and he gave me another fine. I went to court, and pleaded guilty with explenations, again. I wanted to get rid of the case, in one day, because, more of the same type of fines were going to be taken to court. In the morning, I only sleep 3 hours, before I have to go to Court. Becaues I work, until 03:00.
I was given another Good Behaviour Bond, by court, and no conviction. But later on, I've got another letter from R.T.A., telling me that I got another demerit point (the last, remaining point), added to my fine. So, I could only drive, until 12/11/2007. Then, I should stay at home for three months, or I could be given 6 months good behaviour bond, by R.T.A.
No, I am thinking to go back to Fairfield Court, and try to Appeal the last Court case, since, it had to be dismissed, rather than, good behavior bond. But I am not sure, If I could go to high court, without solicitor, at all. Could I represent myself in high-court?
Thank you. Please tell me what I should do. I Appeal it, or carry on with Good behaviour bond, that I am about to get, from R.T.A.).

I said not guilty for 108 in a 100 zone... Because I said not guilty they put you to court (punishment) Went to court judge would not listen to evidence but found case not proven. Vic roads issue 1 point..not happy went to appeal court. case to be heard later this year. 2009 Now got more info and videos of cameras jumping and moving around on their brackets. Experts will be called to prove variety of faults and lack of maintenance..... Big issue for government is 50% of cameras move around on their brackets this destroys their speed calculation. . Take your movie camera to Western ring road and film cameras jumping around in the breeze. The camera movement changes the camera angle and makes the speed calculation completely wrong. (Automatic speed camera calculations include a fixed angle figure as integral part of calculation. (appx 30deg) if the camera moves away from the pre set angle the calculation is null and void ) The cameras are faulty we have to prove this !!!!! What happened to innocent untill proven guilty!!!!.... Lets prove the cameras are faulty and refund the millions of dollars stolen from innocent road users and Mums and Dads going about there business in a legal manner...?? (((Someone needs to look at Wellington road cameras under bridge on east link northbound. this is illegal entrapment.. due to being at the bottom of a long downward gradient and at a busy off ramp where concentration is 100%focused on safe traffic movement not speed. ??? Thats entrapment 100% ))) The bridge bounces too ..
